Member Agreement

General

The Agreement.
This Contract ("Contract") defines the terms of agreement between Buyers and Subscribers and Planet Debate.com, which is operated by Harvard Debate, Inc. Buyers and Subscribers are also bound by the Member Use Policies.

Relevant Documents.
This Agreement is also governed by the Privacy Policy and the Copyright Policy.

Age.
Only individuals 18 and over may operate as Buyers and purchase subscriptions to PlanetDebate.com. Subscribers and members must be at least 13 years of age.

Length of Subscription.
Subscribers are entitled to services from July 1, 2003 until June 25, 2004. All orders currently being processed are for 2003-4. Access will be granted to all available materials as soon as your order is received.

Limitations of Liability

Links.
Planet Debate does not endorse any of the content at the sites beyond itself that Planet Debate links to. Those links are only provided for the convenience of the user.

Prohibitions on Buyers, Subscribers, and Members.
Planet Debate has no practical means to monitor all conduct at its site that could potentially violate the user agreement. Planet Debate therefore does not assume liability to its Buyers or Subscribers for any violation by any individuals other than itself of the Buyer and Subscriber Contract, Terms, Privacy Policy, Copyright Use Policy, or the Membership Agreement.

Idemnification.
Buyers, Subscribers, and Members agree to idemnify, defend, and hold harmless Planet Debate and Harvard Debate, Inc. from any and all liability, penalties, damages, expenses, attorneys' fees and claims caused by or resulting directly from their use of the Planet Debate services which damages them.

Performance.
Planet Debate, Harvard Debate Inc., and Informatics, Inc, Harvard Debate, Inc.'s web service provider, will make all reasonable efforts to ensure that access to Planet Debate is available 24 hours a day, seven days a week. None of these entities, however, are responsible for uncontrolled loss of services due to events such as a natural disaster, warfare, terrorism, or loss of relevant Internet functionality.

Prohibitions on Buyers, Subscribers, and Members

Personal Financial Gain.
Commercial activity for personal financial gain is not permitted. Only those services and programs that have been approved by Planet Debate can be advertised on Planet Debate.

Redistribution of Planet Debate Material.
PlanetDebate and Harvard Debate, Inc. claim copyright ownership of the compilation of the resources and those that resources it has specifically produced. Redistribution of any material from the Planet Debate website is strictly prohibited and penalties against its redistribution will be enforced to the fullest extent of the law.

Posting of Copyrighted Material.
The posted of copyrighted material in violation of fair use standards on the Planet Debate website via message boards, chats, email, or any other means is strictly prohibited. If you believe that copyright information has been placed at the Planet Debate website without permission of its owner, please contact Planet Debate at info@planetdebate.com. Additional information on copyright law is available at the Copyright Website (http://www.benedict.com/).

Tortuous Conduct. Tortuous conduct of any kind, including, but not limited to, the posting of scandalous information, information that evicts emotional distress, or private information without consent is prohibited.

Fraud.
Fraud involves the knowing misrepresentation or misleading statement, writing or activity, made with the intent that the person or persons who receive it will act on it. Fraudulent conduct is prohibited at PlanetDebate.

Pornography.
The posting or exchange of all pornography, copyrighted or otherwise, via the Planet Debate web site is strictly prohibited.

Hacking.
Attempting to access the Planet Debate accounts of other members or attempting to gain illegal access to any other electronic service via Planet Debate resources is strictly prohibited.

Distribution of Viruses.
Using Planet Debate resources to attempt to distribute software that attempts to and/or causes damage or harassment to any persons, data, or computer systems is prohibited.

Inappropriate Language.
Inappropriate language including, but not limited to, the use of profane, abusive, or otherwise indecent language is prohibited.

Criminal and Civil Statutes.
The Provider, Buyer, and Subscriber are prohibited from using the Planet Debate web site for any activity that is prohibited from criminal or civil law.

Subscriber Responsibilities

Familiarity with the Internet and Planet Debate.
Subscribers, Users, and Members should be familiar with the basics of how a database operates and how the Internet functions. Although a detailed instruction manual is available at the site, Planet Debate and Harvard Debate assume no responsibility for training individuals as to how to use the service.

Internet Connections.
Buyers, Subscribers, and Members are responsible for obtaining and maintaining their own Connection to the network that they will need to access the Planet Debate Service.

Enforcement

Immediate Enforcement.
Members, Buyers, or Subscribers who are known to have violated these policies will have all passwords associated with the Buyer terminated without refund. Suspected violators are vulnerable to termination with a pro-rated refund.

Passwords

Passwords are distributed to the Buyers who order the Service. Buyers who purchase the Passwords are entitled to distribute them to any members of their school's forensics program for use, but to those members only. No Password can be used by two or more individuals at the same time. If a new Buyer or Subscriber signs on using the Password the existing Buyer or Subscriber will be logged-off. Buyers may purchase additional Passwords at a discounted rate. These discounted rates are only for use by the school's forensic program members. Passwords will work from July 1, 2002 until June 20th, 2003.

Buyers

Buyers are those who order the service from Planet Debate and provide the means of payment. Buyers must be at least 18 years of age.

Chats

Chats are conventional internet chat rooms where users gather to discuss a particular topic. Buyer and Subscriber-based chats that involve a professional coach will be limited to ten subscribers who will be admitted to the room on a first-come, first-served basis. Each Buyer is entitled to the given number of Chats under his or her contract and if the Buyer permits a Subscriber to engage in a particular Chat this counts against the total number of available Chats.

Members

Members are individuals who register with Planet Debate in order to take advantage of its free services. Members may be Buyers or Subscribers but membership does not entitle one to the Services that are available to Buyers and/or Subscribers.

Planet Debate

Planet Debate, or "PlanetDebate.com," is a website that is owned and operated by Harvard Debate, Inc. of Cambridge, MA.

Services

Services refer to all services offered by Planet Debate.com.

Subscribers

Subscribers are individuals who the Buyer has legitimately given the password to use the system. Subscribers must be at least 13 years of age.

Lincoln-Douglas Topic Tutorial

Each time a new NFL Lincoln-Douglas debate topic is released, Roger Solt will produce arguments that debaters can use on the new topic. These updates will be produced in a timely matter so that debaters can use them shortly after the topic is released.
